TERMS AND CONDITIONS

1. BACKGROUND

1.1
These terms and conditions (the "Terms and Conditions") apply when you place an order as a consumer (the "Customer") via www. Pfolio Posters. The contract is between you and Pfolio Posters. Full contact details and other information about Pfolio Posters can be found on the Website. The Terms and Conditions apply only to customers who are consumers.

1.2
Pfolio Posters reserves the right to refuse or modify a customer's order (e.g. if the customer has provided incorrect personal information and/or has a criminal record for non-payment of a debt).

1.3
Pfolio Posters shall not be liable for sold out products or for any image or printing errors on the website, e.g. errors in product description or technical specification, inaccurate prices and price adjustments (e.g. changed prices from suppliers, currency changes) or incorrect information as to whether a product is in stock. Pfolio Posters is entitled to correct such errors and to change or update the information at any time. If an incorrect price has been quoted for a product ordered by the customer, Pfolio Posters will of course inform the customer accordingly and await the customer's agreement to the changed price before Pfolio Posters continues with the order process. All images on the website are to be considered as illustrations only. These illustrations do not guarantee that they reflect the exact appearance, function, or origin of the product. Pfolio Posters is not responsible for any third-party information provided on the website.

The Website and all its contents are owned by Pfolio Posters or its licensors. The information is protected by intellectual property and marketing laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content cannot be copied or used without the prior written consent of Pfolio Posters.

2. CONTRACTS AND ORDERS

2.1
In order to place an order through the Website, the Customer must accept the General Terms and Conditions. By accepting the Terms and Conditions, the Customer undertakes to comply with the Terms and Conditions in their entirety and confirms that he/she has read the information on personal data and cookies and agrees to use them in accordance with the Pfolio Posters set out herein. Privacy Policy.

2.2
A sales contract is concluded when Pfolio Posters has confirmed the customer's order and the customer has received an order confirmation from Pfolio Posters by e-mail. Pfolio Posters recommends the customer to save the order confirmation for possible future contacts with the customer service of Pfolio Posters regarding the order. The customer is entitled to cancel his order until it has been confirmed by Pfolio Posters. If the order is cancelled, Pfolio Posters will refund any payments made by the customer or their payment or credit card company in relation to the order.

3. CUSTOMER INFORMATION ETC.

3.1
When the Customer registers places an order, the Customer will be asked to provide some personal information. The Customer confirms that the data he/she provides is correct and complete, and is responsible for any errors in the data provided. Information on the processing of personal data by Pfolio Posters can be found on the website Pfolio Posters at Privacy Policy, which is an integral part of these General Terms and Conditions.

3.2
If Pfolio Posters suspects that the customer is misusing its user account or login details or is otherwise in breach of these Terms then Pfolio Posters may terminate the customer's access to the account. Pfolio Posters is furthermore entitled to assign new access data to the customer.

4. PRICES, FEES AND PAYMENT

4.1
Prices quoted on the Website are for orders placed on the Website. All prices are quoted in kr. (DKK) and do not include payment and shipping charges, which are quoted separately. Depending on the destination, orders may be subject to additional charges such as sales tax, duties and levies. Pfolio Posters is not responsible for these additional fees that may apply.

4.2
The customer can pay for their purchase in the manner specified on the website. 

Pfolio Posters is entitled to charge the customer already in connection with the order. Pfolio Posters reserves the right not to offer all payment methods at all times, or to change the payment method if the payment method chosen by the customer, for whatever reason, does not work at the time the order is executed. Please note that the limitations of the available payment methods are set out on the website.

5. SPECIAL OFFERS

Pfolio Posters may from time to time provide special offers on the Website which may have more favorable terms than those set out in these Terms and Conditions, for example in relation to payment or the extended right of cancelation. These conditions apply for the duration of the special offer and to the specific products mentioned by Pfolio Posters in connection with this offer. Pfolio Posters reserves the right to withdraw such special offers at any time. In the event of termination or withdrawal of a special offer, these General Terms and Conditions shall continue to apply unchanged. All offers for specific products on the website are only valid for a limited period of time and until the products are sold out.

6. GIFT CARD

Gift vouchers sold on Pfolio Posters are valid for two (2) years from the date of issue and can be redeemed on the Pfolio Posters webshop. After the expiry date, the card can no longer be used as a means of payment, it cannot be reactivated and any remaining balance cannot be refunded. Your gift card should be kept in a safe place and cannot be redeemed for cash. Lost or stolen gift certificates will not be replaced.

7. COMPETITIONS

7.1

To enter any competition offered by Pfolio Posters you must be 18 years or over. Employees of Pfolio Posters may not enter any Pfolio Posters competition.

7.2
The winner will be selected by. the founder of Pfolio Posters. Full details of the judging process and the names of the judges are available on request by emailing åfolioposters@gmail.com. The jury's decision cannot be appealed. In choosing the winner, the jury will look for the best entry (whatever that may be, depending on the competition).

7.3
The winner will be announced on the social media where the competition takes place and asked to contact us for further information. Prizes cannot be exchanged, transferred or returned and cannot be redeemed by you for cash or any other prize. You will be responsible for any other costs associated with the prize that are not specifically included in the prize. We reserve the right to substitute the prize with another prize of similar value if the prize originally offered is not available.

8. DELIVERY AND SHIPPING

8.1

Products that are in stock will normally be delivered within the number of working days stated on the Website. Unless otherwise agreed (e.g. in connection with the reservation of products that are not in stock), delivery will take place no later than 30 working days after Pfolio Posters has confirmed the order in writing by means of the order confirmation. If you have not received your order within the stated delivery time, please contact our Customer Service within 30 working days after placing the order.

8.2
The estimated delivery time will be stated in the order confirmation and on the current product page on the website. Unless expressly agreed otherwise, if delivery is delayed by more than 30 working days and you as the customer are not responsible for this, you are entitled to cancel the purchase.

8.3
If a product is to be collected from a specified delivery point, the customer must do so within the time specified in the notification. Packages must usually be collected in person with valid ID and order number. The customer will receive a delivery notification indicating when and where the package is to be picked up or received. The notification can be made by e-mail, by post and, if the customer has provided a mobile phone number, also by telephone or SMS. Pfolio Posters has the right to charge the customer a $22 fee if the package is not picked up. For home delivery, a person must be available to receive the package.

9. RIGHT OF WITHDRAWAL

9.1
When purchasing products on the website, the customer has a 90-day right of withdrawal. This means that the Customer has the right to cancel any purchase by notifying Pfolio Posters within 90 days from the date the Customer or the Customer's representative received the Product ordered (the Cancelation Period). Our return and exchange policy does not apply to personalized posters printed on demand. All products must be returned in the same condition in which they were delivered. If the products have obviously been used, we may make a deduction from the refund.

9.2
By accepting the General Terms and Conditions, the Customer acknowledges and agrees that the right of withdrawal does not apply to digital content that is not delivered on a tangible medium.

9.3
In connection with the order of a Product to which the right of withdrawal does not apply, the Customer will receive clear information. If a product has been sealed, the customer may not break the seal if he wishes to exercise his right of withdrawal. The right of withdrawal expires accordingly if the customer breaks the seal. A seal also includes a technical seal (e.g. serial number).

9.4
If the customer wishes to cancel a purchase, he must send a clear message in the manner described here to Pfolio Posters before the end of the cancelation period. The Customer must include in the message its name, address and other relevant information, such as the order number, invoice number and the name of the Product. If the Customer prefers not to use the above alternative message, he/she may use the standard right of withdrawal form provided by National Board for Consumer Policies or other equivalent authority in his/her respective country.

9.5
If the customer exercises their right of withdrawal, the customer is responsible for the cost of return shipping and is responsible for the condition of the product upon receipt of the product and during return shipping. The product must be returned within 14 days from the date Pfolio Posters is notified of the cancelation. The product must be well packaged, in good condition and shipped in the original box and/or packaging. All returns must be sent to Pfolio Posters in accordance with the methods and instructions provided on the website, which can be found here. Depending on the destination, customers may incur additional fees to receive their package. These fees include customs fees, VAT /local taxes, etc. The aforementioned fees are the sole responsibility of the customer/buyer, even in the case of a forced return, i.e. before the package has been delivered to the customer. If you need more information about this, please contact our customer service team immediately.

9.6
If the customer cancels their purchase, Pfolio Posters will refund the amount paid by the customer for the product, including shipping costs. Any additional delivery charges incurred as a result of the customer choosing a different standard delivery method to that offered by Pfolio Posters will not be refunded. Shipping costs will not be refunded if part of an order is returned. Pfolio Posters is entitled to deduct from the amount to be refunded an amount corresponding to the loss in value of the product compared to the original value of the product, if and to the extent that this loss in value is due to the fact that the customer has handled the product to a greater extent than necessary to establish its function or characteristics.

9.7
Pfolio Posters shall refund the amount due without undue delay and in any event no later than 14 days after the date on which Pfolio Posters receives notification of the withdrawal from the contract from the customer. Pfolio Posters may, however, delay repayment until Pfolio Posters has received the product or until the customer has provided evidence that the product has been returned, such as proof of delivery. The repayment will be made to the customer via the payment method chosen by the customer, unless otherwise agreed or there are no objections to such repayment.

10. WARRANTY AND COMPLAINTS

10.1

Some of Pfolio Posters 's products may be subject to a warranty. Information about the warranty period and the specific warranty conditions for each Product are set out on the Website or in these Terms and Conditions. The warranty for products only covers original manufacturing defects and accordingly does not cover defects that occur during or after individual changes to the function and appearance of the product, e.g. conversion, upgrading or other configuration of the product. The customer's order confirmation shall be deemed to be the warranty certificate.

10.2
The right of complaint applies to products that are defective according to the applicable consumer protection law. Any customer wishing to exercise their right to complain about an ordered product must contact Pfolio Posters as soon as possible after discovering the defect, using the contact details provided on the website.

10.3
Plakatpartner.dk shall bear the costs of returning acknowledged complaints.

10.4
Once a rejected product has been returned and the claim has been approved, Pfolio Posters will notify Plakatpartner.dk and refund the customer in accordance with applicable consumer protection legislation. Pfolio Posters will endeavor to do this within 30 days of receipt of the complaint by Pfolio Posters, but this may be delayed depending on the nature of the product. Pfolio Posters reserves the right to refuse a claim if the product is returned in complete

10.4
Once a rejected product has been returned and the claim has been accepted, Pfolio Posters will refund the purchase price to the customer in accordance with applicable consumer protection legislation. Pfolio Posters will endeavour to do this within 30 days of the complaint being received by Pfolio Posters, however, depending on the nature of the product, this may be delayed. Pfolio Posters reserves the right to reject any complaint if the product is found not to be defective in compliance with applicable consumer protection laws. In the event of a complaint, Pfolio Posters will follow the guidelines set by National Board for Consumer Complaints or by the corresponding authorities in other countries.

11. LINKS
Pfolio Posters may provide links to other websites which are beyond the control of Pfolio Posters and websites which are beyond the control of Pfolio Posters may provide links to the Website. Although Pfolio Posters tries to ensure that Pfolio Posters only provides links to websites that apply similar privacy and security policies as set out in Pfolio Posters's Privacy Policy, Pfolio Posters is not responsible for the protection or confidentiality of any information or personal data that the customer provides on other websites. The customer should exercise caution and read the personal data policy applicable to the website in question.

12. FORCE MAJEURE
Pfolio Posters shall not be liable for any delays caused by circumstances beyond the control of Pfolio Posters, such as general industrial action, acts of war, fire, lightning, terrorist attacks, changes in government orders, technical problems, disruption of power/telecom/computer or other communications, and defects or delays in performance by subcontractors due to the above circumstances. Such circumstances will result in damages and other actions. Should such a circumstance arise, Pfolio Posters will inform the customer accordingly both at the beginning and at the end of the period during which the circumstance exists. If the situation has lasted longer than two months, both the customer and Pfolio Posters are entitled to terminate the purchase with immediate effect.

13. CHANGES TO THE GENERAL CONDITIONS
Pfolio Posters reserves the right to amend these general conditions at any time. Any changes to these general conditions will be published on the website. The changes will come into force as soon as the Customer has accepted the General Conditions (when making a new purchase or browsing the Website), or 30 days after Pfolio Posters has informed the Customer of the changes. However, Pfolio Posters recommends the customer to visit the website regularly to be informed of any changes to the general terms and conditions.

14. REVOCABILITY
If any provision of this Agreement is found to be invalid or unenforceable by any court of competent jurisdiction, governmental agency or arbitrator, the remaining provisions of this Agreement and all other provisions shall remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions found to be invalid or unenforceable will be superseded by relevant legal notices and advice.

15. APPLICABLE LAW AND DISPUTE RESOLUTION

15.1
Any dispute will be resolved amicably in the first instance after consultation with Pfolio Posters customer support team. In case of any dispute Pfolio Posters will abide by the rulings of Danish National Board for Consumer Complaints or its counterpart in any other country.
